AfriForum’s private prosecution unit said that African National Congress (ANC) secretary-general, Fikile Mbalula, had a case to answer to for his 2016 Dubai holiday.
In 2016, Mbalula, who was the sports minister at the time, took his family for a holiday in Dubai with a loan obtained from a supplier to the SA Sports Confederation and Olympic Committee (SASCOC).
While the Public Protector found that Mbalula violated the Executive Ethics Act, the National Prosecuting Authority (NPA) declined to prosecute.
AfriForum’s Barry Bateman said that after going through the evidence, the organization believes the NPA’s decision not to prosecute was irrational.
“The evidence suggests collusion between witnesses and the SAPS; a failure to obtain statements from important witnesses and possible suspects; a failure to obtain valuable records and data; and poor cooperation between the SAPS and prosecutors.”
