Gray Homes Construction Directors In Court For Defrauding VP Chiwenga’s Wife US$1 Million

Two directors of Gray Homes Construction [Private] Limited, a construction company based in Harare, have been charged with fraud amounting to $930,000.

The accused, Annavestah Mudiwa, 39, and her husband, Gray Mudiwa, 44, both of Westgate, Harare, are facing three counts of fraud, as defined under Section 136 of the Criminal Law (Codification and Reform) Act, Chapter 9:23.

The Allegations

The complainant, identified as Miniyothabo Francisca Baloyi Chiwenga, 48, is employed by the Zimbabwe National Army and is currently stationed at the Defence House in Harare. According to the court documents, the alleged fraud occurred between March 2023 and August 2024.

Count One outlines that in March 2023, the Mudiwas persuaded Chiwenga to enter into a construction agreement for a double-story house, a cottage, and a boundary wall. The accused misrepresented their ability to complete the project within 90 days, leading Chiwenga to pay them $560,000. However, the funds were allegedly diverted to personal use, and the project was never completed, resulting in a financial loss of $389,100 to the complainant.

Count Two; the Mudiwas are accused of defrauding Chiwenga again in June 2023. This time, they allegedly convinced her that they could construct a warehouse at Chivaraidze Farm in Goromonzi. Chiwenga handed over $550,000 for the project, but the funds were again misused, with the complainant losing $390,000.

Count Three; pertains to a similar incident in September 2023. The Mudiwas allegedly promised to construct a shopping mall at Silalatshani Business Centre in Filabusi. Chiwenga paid them $158,000 for the project, but only $151,000 was reportedly misappropriated, leaving the project incomplete.

Investigation and Arrest

The ZRP’s Criminal Investigation Department (CID) Commercial Crimes Division, Northern Region, led the investigation into the allegations. The couple was apprehended at the Beitbridge Border Post while attempting to flee to South Africa. The police have cited this attempted escape as a primary reason for opposing bail, arguing that the accused pose a flight risk.
